Tourism in Islamic jurisprudence and Iranian law

Abstract

Today, the concept of tourism is considered from many aspects such as jurisprudence, law, economics and sociology. This article studies the first and second rulings on tourism from the jurisprudence perspective and the permissibility or impermissibility of accepting non-Muslim tourism in Muslim societies, and the evidence of the obligation to adhere to covenants with infidels and the ruling on tourism by Muslim and non-Muslim women. Tourism in the natural state is permissible and due to the requirements of time and place it ends up being desirable or obligatory according to its propaganda and guidance effects. Receiving non-Muslim tourists under the auspices of Islamic countries will be permissible and required in jurisprudence in some cases, and Muslim women's tourism takes place within an Islamic framework with its beneficial effects, and women's tourism is not subject to evidence of prohibition.

يعود تاريخ السياحة في الدول الإسلامية على عصور لعيدة كما كانت تحظى بأهمية بالغة منذ ظهور الإسلام، وبلغت ذروة الازدهار في القرن الثالث إلى القرن السابع الهجري حيث كان للعلماء والفقهاء دزر تبليغي وإرشادي كبير في أقصى نقاط الدولة الإسلامية، وتم تأسيس مباني فقهية قوية لدعم السياحة؛ سياحة المسلمين وغير المسلمين وتجوالهم في البلاد الإسلامية كما تم الاهتمام بسياحة النساء، كما ان التركيز على السياحة وتطويرها يمكن ان يكون له دور إعلامي كبير بالنسبة للجمهورية الإسلامية و إيصال الصورة الصحيحة عن البلاد إلى البلاد البعيدة، نع غمكانية جذب السوّاح وتطوير هذا القطاع الحيوي خاصة وان حوالي 23 بالمائة من سكان العالم تحظى بحوالي 12 بالمائه فقط من وجود معالم سياحيةيمكن ان تجذب السائحين، وبذلك يمكن لازدهار القطاع السياحي دعم الاقتصاد وملء الفراغ الموجود في هذا الصدد، وفي هذا الإطار يجب زيادة الوعي والتثقيف حول كيفية التعامل مع السائحين الغير مسلمين والنساء السائحات مع مراعاة المعايير والضوابط الإسلامية.
