حماية النساء ربّات الأسر في الدول الإسلامية:دراسة مقارنة بين القانون الدولي لحقوق الإنسان ومنظومة الحقوق الإسلامية

المستخلص

أدى ازدياد عدد النساء ربّات الأسر في المجتمعات المعاصرة إلى إدراجهن ضمن الفئات الضعيفة، وأصبحت حمايتهن القانونية قضية محورية في حقوق الإنسان والسياسات الاجتماعية. يسعى هذا البحث، باتباع المنهج الوصفي التحليلي والمقارن، إلى الإجابة عن سؤال:كيف تتم حماية النساء ربّات الأسر في الدول الإسلامية، وما أوجه التأثير المتبادل بين النظام القانوني الداخلي للدول الإسلامية ونظام القانون الدولي لحقوق الإنسان؟ ولهذا الغرض، تم بيان الأسس الحمائية في الصكوك الدولية (الإعلان العالمي لحقوق الإنسان، والعهد الخاص بالحقوق الاقتصادية والاجتماعية والثقافية، واتفاقية القضاء على جميع أشكال التمييز ضد المرأة، واتفاقية حقوق الطفل) وفي المنظومة الفقهية القانونية الإسلامية (مؤسسات النفقة والحضانة وبيت المال). كما تم تحليل سياسات خمس دول إسلامية (إيران، السعودية، ماليزيا، مصر، تركيا) في مجالي الرعاية الاجتماعية والتمكين الاقتصادي بشكل مقارن. تظهر النتائج أن الدول الإسلامية انتقلت تدريجياً من النهج الخيري المحض إلى السياسات القائمة على الحق والتمكين. ففي العقد الأخير، شهد النظام القانوني الإيراني تطورات بارزة، من أبرزها:قانون تخفيض ساعات العمل للموظفات ذوات الظروف الخاصة (النساء ربّات الأسر) لسنة 2016، وإلزام قانون خطة التنمية السادسة بإعداد "المخطط الشامل للتمكين"، وتخصيص حصة من التسهيلات المصرفية في قوانين الموازنة، وتغطية التأمين الصحي للقرويين. وتشمل الحلول المقترحة:التفسير الفقهي الديناميكي (قاعدة نفي العسر والحرج، وقاعدة المصلحة)، وسن قانون شامل للنساء ربّات الأسر، وتصميم شبكات للضمان الاجتماعي تقوم على الفقه الحكومي، مما يمكن أن يحقق تقارباً بين النظامين القانونيين ويعزز حماية هذه الفئة.

The increase in the number of women heads of households in contemporary societies has led to their inclusion among vulnerable groups, and their legal protection has become a central issue in human rights and social policies. Following a descriptive-analytical and comparative method, this study seeks to answer the question: How are women heads of households protected in Islamic countries, and what are the aspects of mutual influence between the domestic legal system of Islamic countries and international human rights law? To this end, the protective foundations have been explained in international instruments (the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention on the Elimination of All Forms of Discrimination against Women, and the Convention on the Rights of the Child) and in the Islamic jurisprudential-legal system (the classical Islamic legal institutions of maintenance/alimony (nafaqah), custody (ḥaḍānah), and the public treasury (bayt al-māl)). The policies of five Islamic countries (Iran, Saudi Arabia, Malaysia, Egypt, and Turkey) in the fields of social welfare and economic empowerment have also been comparatively analyzed. The findings show that Islamic countries have gradually moved from a purely charitable approach to rights-based and empowerment-based policies. In the last decade, the Iranian legal system has witnessed significant developments, most notably: the Law on Reducing Working Hours for Female Employees with Special Circumstances (Women Heads of Households) of 2016; the obligation under the Sixth Development Plan Law to prepare a “Comprehensive Empowerment Plan”; the allocation of a share of banking facilities in budget laws; and health insurance coverage for villagers. Proposed solutions include: dynamic jurisprudential interpretation (the Islamic jurisprudential rule of no hardship and constriction (qāʿidat nafy al-ʿusr wa al-ḥaraj), and the rule of public interest (maslahah, qāʿidat al-maṣlaḥah)), the enactment of a comprehensive law for women heads of households, and the design of social security networks based on governmental jurisprudence, which could achieve convergence between the two legal systems and enhance the protection of this group.

سعت هذه الورقة البحثية، باتباع نهج مقارن، إلى دراسة وضع حماية النساء ربّات الأسر في الدول الإسلامية وعلاقته بموازين القانون الدولي لحقوق الإنسان. أظهرت دراسة خمس دول هي إيران والسعودية وماليزيا ومصر وتركيا أنه على الرغم من قبول جميع الدول الإسلامية نوعاً من الالتزام بحماية هذه الفئة الضعيفة، فإن الاتجاه العام في هذه الدول هو الانتقال من المناهج الخيرية القائمة على الصدقات إلى السياسات القائمة على الحق والتمكين الاقتصادي.

شهد النظام القانوني الإيراني في العقد الأخير تطورات ملحوظة تعتبر مهمة من حيث انطباقها مع المعايير الحقوقية. يُعد قانون تخفيض ساعات عمل النساء ربّات الأسر العاملات من 44 إلى 36 ساعة مع الحفاظ على الراتب والمزايا (الصادر عام 2016) خطوة عملية نحو تحقيق "الحق في ظروف عمل عادلة". كما يعتبر إلزام قانون خطة التنمية السادسة (البند "ت" من المادة 80) بإعداد وتنفيذ "المخطط الشامل لتمكين النساء ربّات الأسر" نقطة تحول في السياسات الكلية. كذلك فإن التخصيص السنوي لحصة من التسهيلات المصرفية (القروض الحسنة) لتوظيف هؤلاء النساء في قوانين الموازنة، وتغطية التأمين الاجتماعي للفلاحين والقرويين والبدو (التي وضعت عشرات الآلاف من النساء ربّات الأسر القرويات تحت مظلة التقاعد والعجز) يدل على الانتقال من الحماية المعيشية البحتة إلى التمكين الاقتصادي والاجتماعي. ومع ذلك، لا تزال أوجه القصور الهيكلية مثل حكم الولاية القهرية للأب والجد للأب على الأطفال (المادة 1180 من القانون المدني) تشكل عقبات جدية.
