Human cloning is one of the most prominent ethical and legal issues that has sparked widespread controversy in recent decades, especially with the tremendous advances in genetic engineering technologies. The main challenge lies in determining the position of Arab legal systems on this phenomenon, particularly in terms of the availability of the Sharia (legal) element, which is an essential basis for the crime. This research aims to examine the adequacy of legal texts in Arab systems to address the crime of human cloning, by analyzing relevant national legislation and its consistency with Sharia rules and general principles of criminal jurisprudence.The research examines the concept of the Sharia element of the crime and its nature in criminal law. It then sheds light on the extent to which human cloning is explicitly or implicitly criminalized in Arab legislation, such as Saudi law, Egyptian law, and legislation in the Gulf and Maghreb countries. It also reviews the positions of religious bodies and fatwas, which constitute the foundational basis for the positions of some countries in criminalizing this phenomenon. The study concluded that most Arab regimes lack clear and explicit texts criminalizing human cloning, creating a legislative vacuum that may hinder the prosecution of these acts, despite their categorical rejection in Islamic jurisprudence. The study recommends the enactment of specific penal legislation criminalizing all forms of human cloning, in line with religious values, ethical considerations, and scientific standards.
